There are some people who are under the misconception that when they are purchasing a home, their lender’s attorney, sometimes referred to as the “closing attorney”, is representing them. The attorney for the lender is representing the lender’s interests.

These same people are also under the misconception that the bank’s interests and theirs are the same. The bank’s interest is to make sure that they have properly secured their financial interest in the buyer’s property for having lent the buyers money via a duly executed note securing it by way of a mortgage.

The buyers for a prospective property initially enter into an “Offer to Purchase”. And then follow up executing a ‘Purchase and Sales Agreement” which can be a complicated agreement, requiring both experience, knowledge of the law, and negotiating skills. These documents are generally entered into without any bank involvement, other than a buyer requesting that he be pre-qualified for financing.
